Civil Mediation

In his 20 years of mediation, Mr. Rubin has worked locally, nationally and internationally on an average of 200 mediation cases each year. His experience includes the following practice areas:

• Commercial• Insurance• Intellectual Property
• Corporate• Title VII• Environmental
• Real Property• Zoning/Land Use    • Construction
• Labor Employment    • Health Care• Federal, State & Local Gov’t

Mr. Rubin works with clients in a variety of circumstances, including pre-suit and litigation mediation, pre-suit pro se mediation and private mediation.

Many pre-suit and litigation mediations, where each party has already retained legal representation, are completed in a single session. When appropriate, pre-mediation caucusing is incorporated into the process. At the conclusion of mediation, the lawyers retained by the parties involved will write the settlement agreement.

In pre-suit and other pro se (literally meaning “for themselves”) mediation, where no outside lawyers have been retained, Mr. Rubin will often encourage the parties to take their time with the mediation process, and allow it to extend over several sessions. At the conclusion of the mediation process, Mr. Rubin will draft the settlement agreement; he recommends that each party have their own legal counsel review the agreement prior to signing.
